These Terms of Use (“Terms”) are a legally binding agreement between you and Stranded Media LLC, a Delaware limited liability company (“Stranded,” “we,” “us,” or “our”).

These Terms govern your access to and use of stranded.me, including its pages, content, forms, videos, resources, and related website features (collectively, the “Website”).

By accessing or using the Website, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must stop using the Website.

These Terms apply to the Website only. Services provided to Stranded clients and products such as Mission Control by Stranded may be governed by separate agreements or additional terms.

1. Eligibility and Acceptance

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and able to enter into a legally binding agreement to use the Website.

The Website is not directed to children under 13, and children under 13 may not use the Website or submit Personal Information through it.

If you use the Website on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

Your continued use of the Website constitutes acceptance of these Terms.

2. Website Content

The Website may include content owned by Stranded, content licensed from third parties, client work, portfolio materials, testimonials, case studies, videos, articles, and other resources.

Website content is provided for general informational and promotional purposes only. Although we attempt to keep information accurate and current, we do not guarantee that any content is complete, accurate, reliable, or up to date.

Website content does not constitute legal, financial, medical, tax, accounting, or other professional advice.

Your use of the Website or submission of an inquiry does not create a client, advisory, fiduciary, partnership, or other professional relationship with Stranded. A client relationship is created only through a separate written agreement signed by Stranded and the applicable client.

3. Website Features and Services

The Website may allow you to:

learn about our capabilities and services;
submit contact, consultation, or project inquiry forms;
subscribe to email communications;
complete forms or surveys;
view embedded videos;
download materials; or
access other features that we make available.

Descriptions of services, fees, capabilities, timelines, or deliverables on the Website are not binding offers. Any services provided by Stranded will be governed by a separate proposal, statement of work, service agreement, order form, or other written agreement.

You retain ownership of any intellectual property rights you hold in the materials you submit.

By submitting information or materials, you grant Stranded a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and use them as reasonably necessary to:

respond to your inquiry;
evaluate a potential engagement;
provide requested information or resources;
administer forms or surveys;
operate and improve the Website; and
maintain appropriate business and legal records.

You represent that:

you have the right to submit the information or materials;
your submission does not violate any law or third-party right;
the information you provide is accurate to the best of your knowledge; and
your submission does not contain malware, malicious code, or harmful material.

Do not submit confidential, proprietary, regulated, privileged, or highly sensitive information unless we have specifically requested it and appropriate protections are in place.

Submitting unsolicited information does not require Stranded to treat that information as confidential.

5. Intellectual Property

The Website and its content are owned by or licensed to Stranded and are protected by copyright, trademark, trade secret, and other intellectual property laws.

Website content may include text, graphics, designs, photographs, videos, logos, trademarks, software, code, case studies, reports, frameworks, methodologies, and downloadable materials.

Subject to these Terms, you may view, download, or print a reasonable number of Website pages for your personal or internal business reference purposes, provided that you retain all copyright and proprietary notices.

Without our prior written permission, you may not:

reproduce, republish, or distribute Website content;
modify or create derivative works from Website content;
sell, license, or commercially exploit Website content;
remove copyright, trademark, attribution, or proprietary notices;
use Website content to create a competing product or service;
use Website content to train or develop an artificial intelligence or machine-learning system; or
falsely suggest that Stranded endorses, sponsors, or is affiliated with you.

No rights are granted except those expressly stated in these Terms.

6. Prohibited Conduct

submit unlawful, fraudulent, threatening, defamatory, obscene, or infringing content;
impersonate another person or misrepresent your identity or authority;
engage in spam, fraud, unauthorized advertising, or deceptive activity;

obtain or attempt to obtain unauthorized access to the Website, accounts, servers, databases, or networks;
interfere with the security, operation, availability, or performance of the Website;
collect Personal Information about others without authorization;

scrape, crawl, copy, archive, or systematically extract Website content without written permission;
use bots or automated systems in a manner that places an unreasonable burden on the Website;
reverse engineer or attempt to obtain the source code of Website technology;

We may restrict or terminate access to the Website if we believe these Terms have been violated.

7. Copyright Infringement

We respect intellectual property rights.

your physical or electronic signature.

Submitting false or misleading copyright claims may result in liability.

If Stranded seeks the safe-harbor protections of the Digital Millennium Copyright Act, it may separately designate and register an agent with the United States Copyright Office.

8. Third-Party Content and Services

The Website may contain links to or integrations with third-party websites, platforms, advertisements, forms, videos, and services.

These may include services provided by Google, Mailchimp, Typeform, Vimeo, and other providers.

Stranded does not own or control third-party services and is not responsible for their:

content;
availability;
security;
privacy practices;
accuracy;
accessibility;
products; or
services.

A link or integration does not necessarily mean that Stranded endorses or is affiliated with the applicable third party.

Your use of third-party services is subject to the third party’s own terms and privacy policies.

9. Account Security

Certain Website features or related services may require you to create an account or provide login credentials.

You are responsible for:

providing accurate account information;
maintaining the confidentiality of your credentials;
restricting access to your account and devices; and
all activity conducted through your account.

You must promptly notify Stranded if you suspect unauthorized access to or use of your account.

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, disclose, retain, and protect Personal Information.

The Website currently uses or may use providers including Google Analytics, Google Ads, Mailchimp, Typeform, Vimeo, and other technology and service providers described in the Privacy Policy.

11. No Guarantee of Results

The Website may include case studies, examples, testimonials, statistics, forecasts, marketing observations, or descriptions of results achieved for clients.

These materials are provided for illustrative purposes only. Past performance does not guarantee future results.

Marketing, advertising, search engine optimization, business strategy, and growth outcomes depend on numerous factors beyond Stranded’s control.

We do not guarantee:

search rankings;
website traffic;
leads;
conversion rates;
advertising results;
revenue;
profitability;
business growth; or
any other specific result.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and all content, features, and services made available through it are provided on an “as is” and “as available” basis.

Stranded disclaims all express, implied, and statutory warranties, including warranties of:

merchantability;
fitness for a particular purpose;
title;
non-infringement;
accuracy; and
availability.

We do not warrant that the Website will be uninterrupted, secure, accurate, complete, error-free, or free from viruses or harmful components.

Your use of the Website is at your own risk.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, Stranded and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any:

indirect;
incidental;
consequential;
exemplary;
punitive; or
special damages,

including lost profits, lost revenue, lost data, lost business opportunities, reputational harm, or business interruption arising from or related to your use of or inability to use the Website.

To the fullest extent permitted by law, Stranded’s total aggregate liability arising from or relating to the Website or these Terms will not exceed the greater of:

$100; or
the amount you paid directly to Stranded specifically for access to the Website during the 12 months preceding the event giving rise to the claim.

These limitations apply regardless of the legal theory asserted and even if Stranded was advised that damages were possible.

Some jurisdictions do not permit certain liability limitations, so portions of this section may not apply to you.

14. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Stranded and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, damages, liabilities, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:

your use or misuse of the Website;
your User Submissions;
your violation of these Terms;
your violation of applicable law; or
your violation of another person’s rights.

Stranded may assume control of the defense of a matter subject to indemnification, and you agree to reasonably cooperate with that defense.

15. Termination

We may restrict, suspend, or terminate your access to the Website at any time if we reasonably believe that you:

violated these Terms;
created a legal, security, or operational risk;
misused the Website; or
engaged in unlawful or harmful conduct.

Upon termination, your right to use the Website immediately ends.

Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.

Subject to applicable law, any dispute arising from or relating to these Terms or the Website must be brought exclusively in the state or federal courts located in Delaware.

You and Stranded consent to the personal jurisdiction and venue of those courts.

To the extent permitted by law, you and Stranded agree to bring claims only in an individual capacity and not as a plaintiff or class member in a purported class, consolidated, collective, or representative proceeding.

Nothing in this section prevents either party from seeking appropriate injunctive or equitable relief.

17. General Terms

If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect.

Stranded’s failure to enforce a provision is not a waiver of its right to enforce that provision later.

You may not assign or transfer your rights or obligations under these Terms without Stranded’s prior written consent. Stranded may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or other business transaction.

These Terms and the Privacy Policy constitute the entire agreement between you and Stranded concerning your use of the Website, except where a separate written agreement applies.

Headings are provided for convenience and do not affect interpretation.

18. Changes to These Terms

We may revise these Terms from time to time.

The revised Terms will be posted on this page with an updated “Last Updated” date. Changes become effective when posted unless otherwise stated.

Your continued use of the Website after revised Terms become effective constitutes acceptance of those Terms.
